This Privacy Policy is effective as of the date posted and describes how Gravitater, Inc. (“Gravitater”) collects and uses the personal information you provide on Gravitater’s website (, “Site”) or through your use of Gravitater’s content management platform or services (collectively “Services”). This Privacy Policy is subject to change, through modifications and/or additions to the policies identified here, and the use of information that Gravitater gathers now is subject to this Privacy Policy in effect at the time of use. By accessing Gravitater’s Site or Services, you agree to be, and acknowledge that you are, bound by this Privacy Policy. You should check this Site frequently to see recent changes. Notice of any changes to this Privacy Policy shall be given by posting the new version of the Privacy Policy containing such changes on this Site.  Any access or use of the Site or Services by you after such notice shall be deemed to constitute acceptance by you of such changes.  IF YOU DO NOT AGREE TO ABIDE BY THESE PRACTICES OR ANY FUTURE PRIVACY POLICY, PLEASE DO NOT USE OR ACCESS THE SITE OR SERVICES.  The use of information collected through the Site and Services is primarily for the purpose of providing the Services for which Gravitater’s customers (“Customers”) have engaged Gravitater.

The Information We Obtain From Your Use of this Site and How We Use It

Generic Information – To gauge the effectiveness of this Site, Gravitater may collect certain non-individually-identifiable generic information about visitors of this Site. Gravitater’s servers may automatically recognize a visitor’s Internet service provider, the IP address, the domain name, the type of browser, and the operating system, as well as which pages are viewed on the Site, the web page from which a visitor entered the Site, how much time a visitor spends on each page, and other information related to the operation and interaction of the Site. This information does not reveal a visitor’s identity (for more information, see “Cookies” below).


Gravitater may aggregate this information and use these statistics to evaluate and improve the Site and Services, to monitor performance, and to make the Site and Services easier for you and other visitors to use. Gravitater does not collect IP addresses of end users on behalf of Customers.  Gravitater may combine automatically collected generic information with other identifiable information Gravitater collects about end users.


Identifiable Information – You may choose to provide individually-identifiable information to Gravitater when using the Site or Services. Gravitater may collect general information from you such as your name, email address and phone number and information about your social media accounts, uploads and posts (from end users who upload user-generated content to Customer digital properties or use Customer hashtags on their social media posts). Gravitater collects this information to provide end users and Customers with access to Gravitater Services and Site, in order for prospective and existing Customers to download information from Gravitater, and in order for anyone to contact Gravitater with questions regarding the Gravitater Site and Services.


If you upload user-generated content to your social media accounts that you tag with Gravitater Customers’ brand hashtags, Gravitater may collect that content on behalf of its Customers, including your photo, social media username, caption information (if any) and location information (if any).  If you upload user-generated content directly to a Gravitater Customer digital property, Gravitater may collect your email address, prior to the upload, as well as your photo.  Generally, the information Gravitater collects from end users helps Gravitater and its Customers to communicate with end users regarding content that they have submitted through the Gravitater Services. Gravitater Customers to whom you have submitted content through the Gravitater Services or whose brand hashtags you have included in your social media posts may use your username or email address to communicate with you.  Gravitater may transfer the identifiable information collected to Customers in association with providing the Services.


If you are a prospective or existing Gravitater Customer, Gravitater uses the personal information collected from you to provide you with the information about and access to Gravitater Services.


Gravitater retains personal data provided by its end users and the data it processes on behalf of its Customers for as long as needed to provide the Services. Gravitater will retain and use your information as necessary to comply with its legal obligations, resolve disputes, and enforce its agreements.


Children – Gravitater’s Site and Services are not directed to persons under the age of 13 and Gravitater does not knowingly collect information from children under the age of 13.  If you have reason to believe that a child under the age of 13 has provided personal information to Gravitater, please contact Gravitater at, and Gravitater will endeavor to delete that information from Gravitater’s databases.


Additional Uses – Gravitater may also use information in its records to protect its Customers, employees or property – for instance, to investigate fraud, harassment or other types of unlawful service activities involving Gravitater or other companies that we do business with.  In some cases, it may be necessary to provide this information to the government or third parties who make a lawful demand for it.  Gravitater may also disclose information against someone who poses a threat to Gravitater’s interests (such as customer fraud) or whose activities could bring harm to others.


How Gravitater Releases Personal Information


Gravitater releases the Personal Information it collect in the following circumstances:

  • To Gravitater Customers to whose digital properties you have directly uploaded content or whose brand hashtags you have included in your social media posts.
  • To designated third parties to resolve or investigate abuse complaints.
  • When the information is related to spiders or bots, usually when investigating technical issues.
  • For abusive users, Gravitater may release information to assist in attempting to block the abusive user or to complain to that user’s Internet Service Provider.
  • If necessary to defend against legal claims.
  • When Gravitater deems it necessary to protect the property or rights of the user community, or this Site or the Services.
  • As required by law, such as to comply with a subpoena, or similar legal process.
  • When Gravitater believes in good faith that disclosure is necessary to protect its rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
  • To any other third party with your prior consent to do so, including your consent through acceptance of this Privacy Policy.



How you can Correct Information or Discontinue Communications

Gravitater has no direct relationship with the individuals whose personal data it collects.  Nevertheless, if you are aware of any information Gravitater may have that is incorrect or has changed, or if you no longer desire to receive communications from Gravitater, or you are no longer a Gravitater Customer, you may correct, update, delete or deactivate your information from our records by (for Customers) emailing your Account Manager directly, or (for non-Customers) contacting Gravitater at  We will respond to your request within 30 business days.

If you are an end user of a Customer site or have posted user-generated content with a Customer’s brand hashtags and would no longer like to be contacted by that Customer, please contact that Customer directly.  If the customer requests that Gravitater remove the information from its records, Gravitater will respond to the Customer’s request within 30 business days.

If you elect to receive marketing communications from Gravitater, subscribe to Gravitater newsletter(s) or become a Customer of the Services, Gravitater will use your name and email address, social media username, or other method to send communications to you.  If you no longer wish to receive such communications, you can follow the unsubscribe instructions contained in those emails or contact Gravitater at  Even if you unsubscribe, Gravitater may continue to send you non-promotional Service-related communications.  For example, if Services are temporarily suspended for maintenance, Gravitater might send an email informing you of this change.  Customers may unsubscribe to Service-related communications which are not promotional in nature.  If you do not wish to receive them, you have the option of deactivating your account or of providing another email address for contact, by contacting us at


Public Forums


Gravitater offers publicly accessible blogs or community forums.  Any information you provide in these areas may be read, collected and be used by others who access them.  To request removal of your personal information from our blog or community forum, contact Gravitater at In some cases, Gravitater may not be able to remove your personal information, in which case Gravitater will inform you of the circumstances surrounding Gravitater’s inability to remove the information.  Alternatively, if you used a third party application to post such information, you can remove it by either logging in to the application and removing the information or by contacting the appropriate third party application provider for help.


Cookies, Tracking Technologies and Frames

The Site, Gravitater, our marketing partners, affiliates and analytics providers may use technologies such as cookies, beacons, tags and scripts to improve the level of service, analyze trends on the Site, administer the Site and Services, track users’ movements around the Site and Services, and to speed up the delivery of information to users of the Site and Services.  Cookies are lines of text that are transmitted to your web browser when you visit a Site.  This data string contains your unique user ID for this Site.  Cookies provide a way for a server to recall a previous request or previous registration, or to keep track of a transaction as it progresses, so that information does not have to be repeated.  Your browser stores the information on your hard drive and when you return to this Site later, the cookie is transmitted back only to the servers that originally sent it to you.  You can configure your browser to notify you when you are about to receive a cookie; at that time you will have the option of refusing the cookie.  You can check your hard drive for cookie files according to your browser or system instructions.  If you reject cookies, you may still use the Services, but your ability to use some features or areas of your Services may be limited.

Gravitater partners with third parties to manage its advertising on other sites.  These third parties may use technologies to gather information about your activities on the Site and other sites in order to provide you advertising based on your browsing activities and interests.  If you do not wish to have this information used for the purpose of serving you interest-based ads, your browser settings may be altered to prevent tracking.

Gravitater uses Local Storage (LS) such as HTML 5 to store content information and preferences.  Third parties with whom Gravitater partners to provide certain features on the Site and Services or to display advertising based upon your web browsing activity use LS such as HTML 5 to collect and store information.  Various browsers may offer their own management tools for removing HTML 5 LS.

Some Site or Service pages may utilize framing techniques to serve content to and from our partners while preserving the look and feel of the Site.  Please be aware that you are providing your personal information to these third parties and not to Gravitater where those may exist.

Occasionally, Gravitater uses third party partners to help operate the Site and deliver features of the Services.  Gravitater may share your information with its affiliates, service providers and other parties that provide products or Services for or through the Site or for Gravitater’s business (such as website or database hosting companies, address list hosting companies, email service providers, analytics companies, job application processor partners, and other similar service providers that use such information on Gravitater’s behalf). When you sign up for Services or provide information through the Site, Gravitater may share your personal information with those third party service providers only as is necessary for the third party to provide the applicable service.  These companies are authorized to use your personally identifiable information only as is necessary to proce these services to us.

Gravitater will not sell, lease or give your personally identifiable information collected through the Site or Services to third parties except as otherwise stated in this Policy or with your consent prior to doing so.


The Site or Services may also contain links to other third party websites.  The existence of such a link is not an endorsement, authorization or representation of Gravitater’s affiliation with that third party.  Gravitater does not exercise control over third party websites.  Gravitater is not responsible for the content or privacy practices employed by third party website.  Other websites may have different privacy policies or no policy.  Users should review the privacy policies of any website before providing personal information.  These other websites may use their own cookies.  These cookies collect information independent of Gravitater. Social Media Features

Gravitater’s Site and Services include social media features, such as the Facebook Like button.  These features may collect your IP address and which page you are visiting on the Site, and may set a cookie to enable the feature to function properly.  Social media features are either hosted by a third party or hosted directly on the Site.  Your interactions with these features are governed by the privacy policy of the company providing them.


Gravitater does not participate in the practice of phishing. However, it has become increasingly common for unauthorized individuals to send email messages to customers and end users, purporting to represent a legitimate company such as a bank or an on-line merchant, requesting that the customer provide personal, sensitive information. Sometimes, the domain name of the email address from the email appears to have been sent from a legitimate, trusted company. This “phishing” is an illegal activity. When this happens, the information collected through the email is received by an unauthorized individual to be used for identity theft.  If you receive an email or other correspondence requesting that you provide any personal information via email or a Site that does not appear to be affiliated with Gravitater, or that otherwise seems suspicious to you, please do not provide such information and immediately report such request to Gravitater at


Gravitater operates secure data networks protected by industry standard firewall and password protection systems.  Gravitater’s security and privacy policies are periodically reviewed and enhanced as necessary, and only authorized individuals have access to any personal information relating to Customers or end users. Gravitater has information systems that collect and store information in addition to systems that store its own business records. These systems have different types of security as appropriate for the information stored.  Gravitater requires employees to keep Customer and end user personal information confidential and holds them accountable for their actions. When personal information is transmitted from those information systems to a location outside of Gravitater, such information is encrypted using secure sockets layer (SSL) software.  Nevertheless, due to the inherent nature of the Internet as an open global communications system, Gravitater makes no guarantee as to the security of your information or that your information, when stored on Gravitater servers or when transmitted to or from Gravitater, will be absolutely safe from others, such as hackers.  If you contact Gravitater by email or through a “Contact Us” form on the Site, you should be aware that your transmission might not be secure.  A third party could view information you send by these methods in transit.  If you have any questions regarding security, you can contact Gravitater at

Business Transfer

Gravitater regards its databases of user and Customer information (including personally identifiable information) as a valuable asset. In the event that Gravitater sells all or substantially all of its assets as a result of an acquisition, merger, sale, reorganization, consolidation or liquidation, such databases containing personal information may be one of the transferred assets. In the event of such transfer, you will be notified via email or a prominent notice on the Site of any change in o9wnership or uses of your personal information, as well as any choices you have regarding your personal information.
